Delivery and services
All deliveries and services based on online orders via the Internet are subject to these terms and conditions. Deviating and / or supplementary agreements require the express consent of the store operator. The presentation of the products in the online store is not a legally binding offer, but a non-binding online catalog. By clicking the order button, you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of the order together with the acceptance of the order will be sent immediately after sending an automated e-mail. With this e-mail confirmation, the purchase contract is concluded. Deliveries are currently only possible to delivery addresses in Austria, Germany and some EU countries.

Online orders
The store operator will process and ship incoming online orders without delay. Due to the current global crises, delays in the information of delivery dates may occur, but we try to avoid them,

Transport
Transport damage: If goods are delivered with obvious transport damage, please complain about such defects immediately to the delivery company and contact us as soon as possible. Failure to make a complaint or contact us has no consequences on the legal warranty claims of consumers and serves only to support the provider to assert its claims against the company responsible for the delivery of the goods or the insurance.

The deposited e-mail address of the customer when ordering is communicated to the transport companies of the to ensure added value for the customer by the delivery.

Invoice and payments
Invoices are due immediately and payable without any deductions, unless other payment terms have been agreed upon. Open invoices are due for payment within 14 days. From the 30th day after the invoice date, the store operator is entitled to charge interest on arrears in the amount of 3% above the respective discount rate of the Austrian Federal Bank. A set-off is only allowed with undisputed or legally established claims. The customer may only assert a right of retention if it is based on the same contractual relationship. Net invoices without VAT can only be issued for deliveries to other EU countries if a valid VAT ID number is provided.

Liability for defects / complaints

1) The statutory warranty rights have existed.

2) Consumers are asked to check the goods upon delivery for completeness, obvious defects and transport damage and to notify the store operator as soon as possible. If this is not followed by the customer this has no effect on his statutory warranty claims.

Object of purchase and ownership
The object of purchase remains the property of the store operator until full payment. The retention of title also remains for all claims against the buyer in connection with the object of purchase, e.g. due to repairs as well as other services, subsequently acquired. During the period of retention of title, the buyer is entitled to possession and contractual use of the object of purchase, as long as he meets his obligations from the retention of title and his obligations from the business relationship in due time. The customer is obliged to provide the operator with all information required in the context of a pursuit of rights arising from agreed retention of title.

Non-acceptance of the goods
Ordered and not accepted goods entitle the store operator to terminate the contract. The customer accepts the terms and conditions of the order by sending the order.

Return
(1) You can cancel any order from the contract by returning the goods within 14 days of receipt (deadline begins on the day after receipt of goods) to vi-cosmetic.at:

Prerequisite is that you return the goods to us in their original condition, that is, complete, intact and in their original packaging.

According to § 18 FAGG, the customer has no right of withdrawal / cancellation for:

1. Goods that are manufactured according to customer specifications or clearly tailored to personal needs;

2. Goods that can spoil quickly or whose expiration date would be quickly exceeded;

3. Goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene, provided that their seal has been removed after delivery;

4. Goods that have been inseparably mixed with other goods after delivery due to their nature.

(2) Repayment shall be made by the payment method originally used. If this is not possible, we will contact you to transfer the amount to your account.

Final provisions
The invalidity of individual points of these General Terms and Conditions shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a new provision which comes as close as possible in its economic effect to the invalid provision.

All sales prices are quoted in EURO including VAT. Errors in product descriptions and availability of goods are reserved.

Cost-bearing agreement
If you make use of your right of revocation, you have to bear the regular costs of the return shipment if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of 200 Euros or if, in case of a higher price of the goods, you have not yet rendered the consideration or a contractually agreed partial payment at the time of the revocation. Otherwise, the return is free of charge for you.
